Terms And Conditions
RELEASE OF LIABILITY, WAIVER OF CLAIMS,
ASSUMPTION OF RISKS, INDEMNITY AGREEMENT;
AND PHOTOGRAPH, VIDEO, OR AUDIO CONSENT TO USE
This is a legal binding Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement (collectively, "Release"), made voluntarily by me, the undersigned Releasor, on my behalf, and on behalf of my heirs, executors, personal representatives, legal representatives, assigns, and next of kin to FLIGHT CLUB LLC. As the undersigned Releasor, I acknowledge and fully understand that there are dangers and risks to which I may be exposed by using equipment, participating in fitness classes, and using the facilities. These dangers and risks include bodily injury, permanent disability, paralysis, and death. These dangers and risks may be caused by my own actions, or inactions, the actions of others participating in using the equipment, fitness classes, using the facilities, or other activities, the condition in which the activity takes place, or the negligence of the "Releasees" named below. There may be other risks and social and economic losses either not known to me or not readily foreseeable at this time, and I fully accept and assume such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the activity. I have been informed and acknowledge that this fitness class is reserved for persons eighteen (18) years or older. By signing this document, that if taking part in these fitness activities, I am eighteen (18) years or older. If you are of the ages between 12-17, you will need a parent or guardian present to sign this waiver and agree to all terms and conditions. I hereby release, discharge, covenant not to sue, and agree to indemnify and save and hold harmless FLIGHT CLUB LLC, its owners, employees, agents, other participants, event sponsors, and, if applicable, owners and leasers of the premises on which the activity takes place (each considered one of the "Releasees" herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the "Releasees" or otherwise. I have read this agreement, fully understand its terms, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by the law. I further agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.
I also do hereby consent to the use by FLIGHT CLUB LLC of my image, video, voice, or all three of them. In addition, I waive any right to inspect or approve the finished photographs or video recordings. I agree that all such pictures, video, or audio recordings and any reproduction thereof shall remain the property of the author and that FLIGHT CLUB LLC may use it as it sees fit. It is understood that this material will be used in a legitimate manner, both internally and outside FLIGHT CLUB LLC and is not intended to cause any harm or undue embarrassment to the parties involved. I understand that this consent is perpetual, that I may not revoke it, and that it is binding. I understand that these images may appear publicly as part of FLIGHT CLUB LLCs website, social media, and/or other marketing materials.
